Cook County, Illinois - Successfully defended Corporate client and its owners Cook County Chancery Court. The Court granted our motion to dismiss 3 out of 4 counts. In the remaining count, the Court indicated that it was going to grant our motion as well, but, upon request of the plaintiff, has given the plaintiff time to further brief the matter to answer some questions the Court had posed.  Nutristat is a locally owned Illinois, husband-and-wife-run company, that sells sports nutrition products.

 

Cook County, Illinois – Corporate client prevailed as the Court dismissed our opponent’s emergency motion for attachment of my client’s operating inventory.



CRIMINAL NEGOTIATIONS


Will County, 7 separate Driving on License Suspended cases
, August 2019, Court initially indicated it would give 120 days jail the Prosecution demanded, but after sentencing hearing convinced the Court to give out community service hours instead.



DuPage County – 2 Violations of Felony Probation,
September 2017, State's Attorney originally sought to revoke the client's probation and send him to prison for 2-5 years. After months of representation where we prepared and presented a long history of compliance, we convinced the State's Attorney and the Judge to drop the violations, and allow the client to continue on his probation.

Will County case 15 TR 26764 Speeding, Class B Misdemeanor 26-34 mph over (79mph in a 45mph zone) – This was a 16-year-old client who was facing severe consequences to his graduated driver’s license, not to mention a mandatory criminal conviction.  We were able, after a few court appearances, to convince the prosecutor to amend the charge to a lower, fine only, petty offense of 25mph over.  The client was given court supervision with a small fine, community service and 4 hours of traffic safety school.  No conviction was recorded on the client’s traffic and criminal records.

LaSalle County case 14 TR 11508-11 Driving While License Suspended – The prosecutor wanted a conviction, which would have caused an additional 1 year of loss of driving privileges and 60 days of county jail.  Not only did we convince the judge to keep this father of four out of jail, the client was given supervision which kept the offense off of the record and the client had not additional loss of driving privileges.

Will County case 14 CF 2483 the Defendant was facing a minimum of 6 to a maximum of 30 years prison with no probation as an option for a class X delivery of LSD.  Despite the client having a prior felony drug conviction and other misdemeanor convictions, we ultimately convinced the prosecutor, after presenting him with mitigations material, to offer the minimum 6 years, and then again to drop the charge to a lesser class 1 possession with intent with a “boot camp” recommendation. If successful, the client will be home in 6 months.  Much sooner that the years he would have spent in prison under the mandatory minimum 6 years on the original class X.

Kane County case 14 TR 68971 Driving While License Suspended – The Client was looking at a Felony Upgrade because of his prior record, but we convinced the prosecutor to keep the case as a misdemeanor and allow the Client to do community service hours at his church instead of doing the minimum jail time.

Will County case 14 CF 576 the Defendant was facing 3-7 years prison for a class 2 felony possession of drugs with intent to deliver.  Not only were we able to negotiate the case to a lesser class 3 possession of marijuana, but we were able to get probation with no additional incarceration, despite there being a previous firearm felony probation and other criminal history. In addition, in the concurrent asset forfeiture case, we were able to negotiate a return of half of the $20,000.00 in cash seized and some personal electronics as well. The client was able to pay our fees with a down-payment, a percentage of the asset return, a partial bond assignment and the balance on a payment-plan.

DuPage County case 14 TR 84307, Aggravated Speeding +35 mph, Reckless Driving, Following Too Closely, and Improper Passing/Lane usage – the Client was looking at a suspension of his license upon conviction.  We negotiated Supervision on an amended charge if simple speeding which stayed off of the Client’s record.  The remaining charges were all dismissed.  The judge told the client that he better appreciate the outcome as the judge almost never sees such a favorable outcome.

Kane County case 14 TR 48678 Driving While License Revoked– The Client had 5 prior offenses and the prosecutor originally demanded 120 days in jail.  We eventually persuaded the prosecutor to drop the jail down to 90 days, then 60 days, and then finally 45 days.  Also, we convinced the prosecutor to agree to allow the jail to be served on weekends so the client could keep his job and maintain his income for his family.  The judge specifically told the client that this was one of the best negotiations that she saw for this type of case and history.

D.U.I. and Driving While License Suspended, DuPage County case # 13 DT 2904 - the client was facing charges of D.U.I. and Driving on a Suspended License. The State demanded a conviction which would have Revoked the license for this single-father-of-2 who also cares for his disabled mother. The State emphasized that this case involved a property damage only accident and that this was the 2nd arrest for D.U.I. and that there was a criminal history. We convinced the judge to grant Court Supervision on both counts saving the client's license, job and ability to support his family. The client has been able to pay our fees on a payment plan.

Class 4 Felony Aggravated Fleeing and Eluding a Police Officer, 12 CF 2793; and Class X Felony Armed Robbery, Class 1 Felony Aggravated Robbery, and Class 2 Felony Burglary, 13 CF 385 Will County – Original offer to the client’s public defender was 18 years combined Department of Correction on both the Class X Armed Robbery and the separate Class Aggravated Fleeing and Eluding.  The client had a prior felony conviction and misdemeanor convictions for attempted criminal damage to property and attempted resisting a police officer.  The family hired me to replace the public defender and, over the course of several months, I was able to convince the prosecutor to keep lowering the sentence from 18 years to 12 years, then to 8 years.  Finally I convinced the prosecutor to dismiss the Fleeing and eluding case completely, and they agreed to 4 years prison (The absolute minimum prison sentence) on the Class 1 Aggravated Robbery and dismissed the more severe class X Armed Robbery and the Burglary.  Essentially I saved the client 14 years of prison time. 

Two class X, three class 1, one class 2, three class 4 felonies, DuPage County 12 CF 1165 - mandatory minimum 19 to  36 years – Original offer was 19 years of prison, negotiated down to one class 1 and one class 4 felonies for 10 years (to actually serve 5 years, half of sentence).

 

Unlawful Use of Weapon class 3 felony, possession of a controlled substance, class 4 felony, Will County 13 CF 1993 – client had 2 prior felony and 1 misdemeanor convictions - original offer – 3 years in Prison.  The offer was negotiated down to 2 years prison on the lesser class 4 felony possession of drugs and a dismissal of the greater class 3 weapon charge.  The offer was negotiated even further down to 1 year which meant the client would serve approximately 2 months and be back home with his son in time for the holidays. 

DuPage County 12 CF 1165, Two Clas X, three Class 1, one Class 2, three Class 4 felonies for Aggravated Criminal Sexual Abuse – mandatory minimum 19-36 years in Prison. The original offer was 19 years prison, which after months of negotiations was finally reduced to one Class 1 and one Class 4 felonies for an agreed 10 years (to actually serve 5 years, half of the sentence).

 

Theft, 13 CM 1120 Will County - a claim of theft of services from Com Ed for rigging a power meter to under report usage.  The State’s Attorney originally wanted a conviction of record and over $8,000.00 in restitution to Com Ed.  Convinced the prosecutor agree to a lesser figure of just over $2,000.00 in restitution and to agree to Court Supervision, keeping the case off of the client’s record as a conviction.

 

Driving While License Suspended, 13 TR 7319-20 Grundy County - original offer – conviction, 1 year extension of revocation, 24 months probation and 30 days of jail. Client had a small child and no other family to help.  Convinced prosecutor to agree to Conditional Discharge instead of probation and no jail, but 300 hours of community service.

 

Possession of Cannabis, 13 CM 421 Kane County - the client was on Parole after serving time in the department of corrections for a prior felony.  The State’s attorney wanted 60 days of jail.  The client would lose a good job.  Convinced the prosecutor to agree to Conditional Discharge with no jail and just a small fine.

 

Possession of a firearm without a FOID card, Possession of ammunition without a FOID card, and Unlawful use of a Weapon, 13 CM 794-6 Grundy County - The State’s attorney was going to raise the charges to a felony due this this gentlemen forgetting that his wife left her loaded shotgun in the vehicle he was driving, in the back seat and not in a case.  The shotgun was a family heirloom handed down from the now deceased father valued at approximately $3000.00.  Despite having a felony background the State’s attorney was convinced to keep the charge a misdemeanor, allowed us to plead guilty to one charge and two others were dismissed for a fine only and conditional discharge.  The shotgun was ordered returned to the wife.

 

Driving While License Suspended, 13 TR 17862-3 Will County - Client had 6 prior Diving on Suspended convictions and the State wanted to convict him again, further suspending the license for another year and sending the client to County Jail for 100 days.  We plead blindly to the Judge and argued against the state – the judge sided with us and gave the client Supervision, preventing any further suspension with no jail but a small fine and some community service.

 

Retail Theft, 12CM5340 Kane County - several prior misdemeanor and Felony convictions, including Prison sentences – negotiated 40 days jail on a misdemeanor with no probation down from 1st offer of 250 days jail or Felony upgrade.

 

Driving While License Revoked, 13 TR 2370 Grundy County - original Offer – conviction, 1 year extension of revocation, 24 months probation and 10 days of jail – final agreement – 12 Months Supervision, no conviction, no extension of revocation, no jail.

 

Driving While License Suspended 2nd and third offenses 13 TR 2426-7 and 13 TR 2156-7 LaSalle County - original offer 30 days of county jail and conditional discharge with fines and costs – final agreement - conditional discharge with no jail and fines and costs.

 

Driving While License Revoked, 13 TR 263 LaSalle County, 2nd offense after 2 prior DUIs - original offer 1 year conditional discharge with 1 year extension on revocation and 180 days of jail fines and court costs, negotiated down to 90 days jail, and final result:  1 year court supervision, no conviction on record, no extension of revocation no jail and no fines or court costs.

 

Speeding 30+ MPH over, Class B misdemeanor, YW 647399 Cook County - despite a spotty record, convinced the State’s Attorney to drop the charge down to a simple petty offense by reducing the speed as cited, then received Court Supervision keeping a conviction off of the client’s record.

 

Driving While License Suspended, 7th offense, 13 TR 68447-8 Kane County - convinced the prosecutor to back off of original demand for 60 days of county jail and agreed to 300 hours of community service work instead on a term of conditional discharge.

 

Driver’s License Suspension, 14 TR 8834 DuPage County - was able to reopen an old traffic ticket, vacate the failure to appear conviction, and get a supervision order.  This allowed the pending suspension of the Driver’s License to be removed before it took effect.

 

Leaving the Scene of an Accident, Failure to Reduce Speed to Avoid Accident, Driving Too Fast for Conditions, 14TR74436 DuPage County - a young man, still on his permit and not having a full driver’s license took his father’s vehicle without permission and then caused a motor vehicle accident and then fled the scene.  We got all charges dismissed by demanding a bench trial and plead guilty to the minor offense of driving without a valid license and received court supervision keeping even that minor offense off of the young man’s record.
